Terms of Service

DirtBid ("the Service") is a construction cost-estimating platform for site work in Virginia, operated by DirtBid ("we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a company, you represent that you can bind that company to these Terms.

This section matters more than any other. Estimates, soil analyses, hazard flags, unit prices, and reports produced by the Service are planning-level screening tools. They are NOT: a geotechnical report, an engineering opinion, a survey, a bid guarantee, or professional advice of any kind. Soil characterizations derive from public data (USDA-NRCS soil surveys and county-level records) that varies parcel to parcel. A site-specific investigation by licensed professionals governs all design, pricing, and construction decisions. You are solely responsible for every bid you submit and every business decision you make using output from the Service.

Parts of the Service use artificial intelligence, including supplementary price lookups, plan analysis, and the scope assistant. AI output can be wrong. AI-sourced prices are labeled with their source and confidence, and prices outside our reference ranges are flagged — but the responsibility to verify pricing before relying on it is yours.

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. Free-trial accounts include usage allowances (currently 3 projects and 5 soil analyses); paid plans lift these limits per the pricing page.

You own the project data, estimates, and documents you create. You grant us the limited rights needed to operate the Service (storage, processing, backup, and display back to you). We do not sell your data. See the Privacy Policy for details.

Do not: abuse, probe, or overload the Service; access other users' data; resell or scrape the cost database; use the Service for unlawful purposes; or reverse engineer the platform. We may suspend accounts that do.

Paid plans are billed in advance on a monthly or annual cycle and renew automatically until cancelled. You may cancel anytime; access continues until the end of the paid period. Prices may change with 30 days' notice. Fees are non-refundable except where required by law.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that estimates will match actual costs or that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost bids, cost overruns, or construction losses arising from use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination we will make your data available for export for 30 days unless the law requires otherwise.

We may update these Terms; material changes will be announced in the app or by email, and continued use constitutes acceptance. These Terms are governed by the laws of the Commonwealth of Virginia, USA.
